Terms of Service
Effective date: October 1, 2026 · Last updated: October 8, 2026
1. The agreement
These Terms are an agreement between you and Pathnext Industries, LLC ("Pulsekit", "we"), which runs Pulsekit at getpulsekit.com. They cover our website, free checkups, reports, accounts, subscriptions, one-time reports and fix work (together, the "Service").
You agree to these Terms and our Privacy Policy when you tick the box to run a checkup, create an account or make a purchase. If you act for a company, you confirm you may accept these Terms for it, and "you" includes that company. If you don't agree, don't use the Service.
Who can use Pulsekit. You must be at least 18. Your business must be located in the United States. Pulsekit is for businesses and professionals, not for personal, family or household use. It isn't offered in the EU, the UK or anywhere else outside the US.
2. What Pulsekit does
Pulsekit checks what customers, search engines, AI assistants and job seekers can see about a business from the public internet. We report it as "pulses", each with a score, what changed and a fix list. We may add, change or retire pulses and features.
Our scanner. PulsekitBot reads public pages only and honors robots.txt. It never logs in, submits forms, tries passwords, solves CAPTCHAs or gets around firewalls. The full list of what it requests is at getpulsekit.com/bot.
Free checkups and plans. A free checkup shows a security score only. Security findings, version and plugin detail, and checks of admin and login pages are only for websites on a Pulsekit plan (section 3).
Our own checkups. We sometimes check businesses that didn't ask us to, for research or before contacting them about Pulsekit. Those checkups read public pages only, honor robots.txt, request no admin or login paths and produce no security findings. Site owners can opt out at getpulsekit.com/bot.
What reports are not
Please read this part carefully.
- Not advice. Reports are information. They are not legal, accessibility, security, financial, employment or tax advice.
- Not proof of compliance. A score or report does not mean your site complies with the ADA, WCAG, Section 508, PCI DSS or any other law or standard. Neither does our fix work. Automated checks can't find every issue.
- Not a security certification. Our checks are passive and limited to what's publicly visible. They are not a penetration test, audit or vulnerability assessment. A good score doesn't mean your systems are secure.
- Not always right. Reports depend on public pages, third-party sources and automated analysis. Any of them can be unavailable, out of date, blocked or wrong.
- AI content can be wrong. Parts of reports are written or summarized by AI. What third-party AI assistants say is their output, not ours. Check anything important before you act on it.
- Our own scoring. Scores are our method for tracking direction over time, not an industry standard.
- Competitor information comes from competitors' public pages and third-party sources. It is for your internal comparison only.
- Google ratings are shown live on your results page and aren't saved in reports. We don't show or compare competitors' ratings. Our Privacy Policy has the details.
3. Your responsibilities
Only check sites you own or are authorized to check. You may request a checkup, add a site or buy a pulse only for a website you own or control, or that the owner has permitted you to have checked.
Competitors. You may enter competitor websites only where a pulse asks for them. Competitor Watch also finds nearby competitors itself. For competitors we read public pages only and run no security checks.
Security detail for sites on a plan. When you add a site to a plan, you tick a box confirming you own it or are authorized to have it checked. Relying on that, reports for that site show full security detail. We don't verify ownership yet. If you tick the box for a site you aren't authorized to have checked, you're responsible for that (section 8), and we may stop scanning it.
You agree not to:
- use the Service to harass, defame or harm anyone, or to plan or carry out an attack on any system;
- use PulsekitBot to probe or overload sites you aren't authorized to test, or to get around a site's robots.txt, firewall or access controls;
- overload the Service, get around our rate limits or bot checks, or create many accounts to get extra free checkups;
- copy or resell the Service or reports in bulk, or use them to build a competing product;
- reverse engineer the Service, except where the law allows it despite this restriction;
- misuse report links, sign-in links or your verify token, or access someone else's account or reports;
- submit false information, malware or unlawful content;
- break any law in using the Service, including privacy, anti-spam, computer-misuse and export laws.
Your account. We sign you in with emailed links. You're responsible for activity under your account and for keeping your email secure.
Firewall rules and your verify token. If your firewall blocks PulsekitBot, you may choose to allow requests that carry our user agent and your site's private verify token. That is your decision and your configuration. Keep the token private: anyone who has it can pass your rule. If you think it's been exposed, remove the rule and tell us; we'll issue a new one within 2 business days. You're responsible for your firewall settings and for reverting them if you stop using Pulsekit.
If you break this section. We may suspend or limit scans, accounts or access, without refund where the law allows, if we reasonably believe you've broken this section or are putting the Service, a site owner or others at risk.
4. Plans, billing and cancellation
| Topic | Rule |
|---|---|
| What a plan covers | One website and one business location. A business with several locations needs a plan for each. The same applies to a one-time report. |
| Your plan and price | The ones shown at checkout and on your order confirmation, in US dollars. Prices exclude taxes. We add any sales tax that applies at checkout. |
| Payment | Stripe processes payments under its own terms. By subscribing you authorize us, through Stripe, to charge your payment method each month until you cancel. |
| Renewal | Monthly pulses and bundles are billed in advance and renew automatically every month until you cancel. |
| One-month minimum | Each pulse or plan is billed for at least one full monthly billing cycle. |
| Adding a pulse mid-period | We charge the prorated difference that day, then the new monthly total from the next renewal. Because of the minimum, a pulse you add is billed for that prorated part plus at least one full month, even if you remove it sooner. We show this where you add a pulse. Charges under $0.50 are waived. |
| Cancelling or removing a pulse | You can do either online at any time, from your account or the Stripe customer portal. It takes effect at the end of the period you've paid for, or at the end of the one-month minimum if that's later. You keep access until then. |
| Pauses | You can't pause a pulse or plan on request. Billing pauses only automatically, for a blocked pulse (section 5). To stop future charges, cancel. |
| Failed payments | Stripe retries on its normal schedule, and your monthly pulses stop running in the meantime. If a payment goes through, they start again; the billing period isn't extended or prorated for the days they didn't run. If the final retry fails, your subscription is cancelled. |
| Price changes | We may change prices for future billing periods. We'll tell you 30 days before an increase takes effect on an existing subscription, and you can cancel before then. |
| Partial refunds | None. We don't refund or credit partial periods, unused time or pulses removed mid-period. The exceptions are blocked pulses (section 5), where the law requires otherwise, where section 9 provides, or where we decide to in a particular case. |
Asking us to stop scanning your website. If you're a subscriber and ask us, from your account's email address, to stop scanning your own website, we treat it as cancelling that website's subscription under the cancellation rule above. We stop scanning right away. Billing stops at the end of the period you've paid for, or the end of the one-month minimum if that's later. Your existing reports stay available until then, and no refund is due. To be scanned again, email us from the same address.
Earlier products. The Competitive Teardown and Pulse Monday products have ended. Purchases of them are handled under the terms that applied when you bought them. Where no written terms applied, these Terms do.
5. Blocked checks, pauses and refunds
Blocked checks. A check is blocked when your firewall stops PulsekitBot or your robots.txt disallows it from your homepage. Blocked checks are marked "blocked", aren't scored and don't count as a delivered monthly report. We retry daily and tell you how to let us in. A robots.txt block is handled like a firewall block; it isn't a cancellation.
Billing pause. If a monthly pulse is still blocked 3 days after its first blocked run, we pause billing for that pulse and credit the blocked part of the current billing period on your next invoice. Billing resumes automatically after the first run that gets through, and the rest of that period is added to your next invoice.
- Example. A pulse is first blocked on day 10 of a 30-day period and gets through on day 20. Billing pauses on day 13. You aren't billed for days 10 to 20.
- Bundles. Your price drops by the paused pulse's share. Your other pulses keep running, billing and their discount.
- The minimum. A pause doesn't extend the one-month minimum. You can remove a paused pulse at any time with immediate effect.
- Credits apply to future invoices and aren't paid out in cash.
- While a payment is failing, billing for a blocked pulse doesn't pause, because your pulses aren't running. The 3 days are counted again from the first blocked run after the payment goes through.
One-time reports. A one-time report is a single full report for one website, paid in advance and delivered when the scan completes. It has no monthly comparison.
- If it's blocked, it isn't delivered. We retry daily, and you can re-run it at no charge once you let us in.
- If it's still blocked after 14 days, we refund it in full to your original payment method within 10 business days.
- If only some pulses stay blocked, we deliver the rest and refund the blocked pulses' share.
- Otherwise a delivered one-time report isn't refundable, except where the law requires, where section 9 provides, or where we decide to in a particular case.
6. Fix work
Fix work is billed by the hour under a written scope that we agree with you before work starts.
- Rates. The hourly rates shown on our site and in your written scope.
- Estimates. Any fix we expect to take more than 2 hours gets an hours estimate first. The estimate isn't a cap, and we ask for your approval before going over it.
- The scope controls. If the written scope conflicts with these Terms on that work, the scope wins.
- No guarantee of outcome. Section 2 applies to fix work. For example, accessibility fix work improves the issues in scope but doesn't certify compliance.
Ownership and access. Once you have paid for the work, you own what we deliver for you. We keep our own tools, methods and know-how. You give us only the access the work needs, you keep your own backups, and you can remove our access at any time.
7. Content and ownership
- Your content. You keep ownership of what you give us, such as site details, competitor lists and ideas. You give us permission to use it to provide and improve the Service.
- Ideas and feedback. We may use ideas and suggestions you send us freely, and rewrite them in our own words on our public roadmap, without owing you anything. We never show your name or email there.
- Reports. You may use reports for your own business and share them with your team, advisers and the people who build or maintain your site. Don't present a report as a certification or alter it to misrepresent our findings.
- Our content. The Service, our software, scoring methods, designs, text, and the Pulsekit name and logo belong to Pulsekit or our licensors. These Terms give you no rights to them except to use the Service as described.
- Third-party services. The Service relies on third parties, including payment, data and AI providers. Their services are governed by their own terms, and we aren't responsible for them. Their outages or changes can affect what a report includes. Some checks use YouTube API Services; by using them you agree to the YouTube Terms of Service at youtube.com/t/terms.
- Confidentiality. We keep your reports and account information confidential and use them only as these Terms and our Privacy Policy describe.
8. Warranties, liability and indemnity
No warranties. To the fullest extent the law allows, the Service and all reports are provided "as is" and "as available", without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation. We don't warrant that reports will find every issue, or that following our recommendations will produce any particular ranking, revenue, or legal or security result.
Limit of liability. To the fullest extent the law allows:
- Pulsekit and its owners, employees and contractors won't be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if told they were possible.
- Our total liability for all claims related to the Service or these Terms is limited to the greater of (a) what you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.
- These limits apply to every theory of liability, including contract, negligence and statute, and even if a limited remedy fails of its essential purpose.
Nothing in these Terms limits liability that the law doesn't let us limit, such as liability for fraud or intentional harm.
Indemnity. You'll defend, indemnify and hold harmless Pulsekit and its owners, employees and contractors from claims, losses and costs, including reasonable attorneys' fees, that arise from:
- your use of the Service in breach of these Terms;
- any checkup you requested of a site you weren't authorized to have checked;
- your content; or
- your violation of law or of someone else's rights.
This indemnity doesn't cover a claim to the extent our own breach of these Terms caused it.
9. Ending the Service, disputes and general terms
Ending the Service. You can stop using the Service at any time and cancel as section 4 describes. We may suspend or end your access if you breach these Terms, if the law requires it, or if we stop offering the Service. If we end the Service for a reason other than your breach, we refund prepaid fees for the unused part of the current billing period. Sections 2, 7, 8 and 9 continue to apply afterwards.
Governing law. These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules.
Disputes. Before filing a claim, each side will try to resolve the dispute informally for 30 days by emailing the other; reach us at hello@getpulsekit.com. After that, any dispute will be brought only in the state or federal courts located in King County, Washington, and both sides consent to their jurisdiction. Either side may instead bring a qualifying claim in small-claims court.
Changes to these Terms. We'll post the new version here with a new date. For material changes we'll email account holders at least 30 days ahead. If you keep using the Service after the changes take effect, you accept them. If you disagree, cancel before then.
General.
- Entire agreement. These Terms, the Privacy Policy and any written scope or order form you agree with us are the whole agreement about the Service.
- Assignment. You may not transfer these Terms without our consent. We may transfer them to a successor in a merger, acquisition or sale of assets.
- Severability and waiver. If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term isn't a waiver.
- Events beyond our control. We aren't liable for delays or failures caused by events beyond our reasonable control, including outages at our providers.
- Notices. We send notices to the email on your account. Send notices to us at hello@getpulsekit.com.
- Export. You'll comply with US export control and sanctions laws.
